RCI in Teoh Beng Hock case expanded, amazing what elections can do isn't it

Kerajaan juga menetapkan terma rujukan Suruhanjaya adalah seperti berikut;


a. untuk menyiasat sama ada atau tidak terdapat apa-apa ketidakwajaran dalam perjalanan pemeriksaan Teoh Beng Hock dalam perjalanan penyiasatan Laporan Shah Alam Nombor 0052/2009 oleh Suruhanjaya Pencegahan Rasuah Malaysia berhubung dengan Perintah-Perintah Tetap dan amalannya dan untuk mengesyorkan apa-apa tindakan yang sesuai, jika perlu; dan


b. untuk menyiasat kematian Teoh Beng Hock dan hal keadaan yang menyelubungi dan membawa kepada kematiannya.


In English:


a. To enquire whether or not there was any impropriety in the conduct of the examination of Teoh Beng Hock in the course of an investigation into a Shah Alam report 0052/2009 by the Malaysian Anti Corruption Commission in relation to its standing orders and practices and to recommend any appropriate action, where necessary, and


b. To enquire into the death of Teoh Beng Hock and the circumstances surrounding and contributing to his death.


Well I hope Teoh Beng Hock's family will be happy, I know Lim Kit Siang is cautiously happy, its not everyday that the Government of Malaysia succumb to pressure from the Opposition and make a 180 degree turn in less than 1 month. Amazing what political elections can do isn't it.


I do not agree with the expanded scope of the RCI simply because an RCI and the procedures it has to follow and the defined time duration of three months is not equipped to investigate a death whether due to suicide or murder. That is why we have an Inquest and procedures to apply for revision of the inquest verdict at the higher courts. What is going to happen to the AG's application for a revision of the Teoh Beng Hock inquest verdict at the High Court then?


This is going to be a bad precedent, somebody somewhere will be asking for RCIs for death in police custody, immigration custody and many other law enforcement custodies. 


If the Government start allowing for an RCI for deaths of this nature, then it will turn political with people asking why Teoh's death can but other people's death cannot, NOT fair. It will turn political, it will turn ugly, the Opposition will be rubbing their hands with much glee. What would PM Najib's Government do then? Damn you do, damn you don't.


Anyway, the die has been cast and the DYMM Agung has given his consent to the RCI. I hope that the family of Teoh Beng Hock will accept any findings that the RCI come up with as it may not necessarily be the finding that they wanted it to be.
