Nazri: MP Pakatan 'bodoh dan gila'

Menteri di Jabatan Perdana Menteri, Datuk Seri Mohd Nazri Abdul Aziz melabelkan ahli parlimen Pakatan Rakyat sebagai 'bodoh dan gila' kerana mengugut untuk mengheret speaker Dewan Rakyat, Tan Sri Pandikar Amin Mulia ke mahkamah.
Mengulas kenyataan ahli parlimen Bukit Gelugor, Karpal Singh - Nazri, menteri yang bertanggungjawab ke atas hal ehwal parlimen berkata mahkamah tidak boleh mencampuri urusan atau prosiding Dewan Rakyat.
“Ini kerja gila dan saya percaya ia akan ditolak oleh mahkamah kerana parlimen ada supremasinya,” katanya di lobi parlimen hari ini.
Menurut Nazri telah ada penghakiman yang dengan jelas menyatakan bahawa mahkamah tidak mempunyai jurisdiksi atau bidang kuasa ke atas Parlimen.
“Ini adalah kedaulatan Parlimen dan supremasi Parlimen. Ada tahi lembu di kepala mereka.Saya beri jaminan jika, ini dibawa ke mahkamah, ia akan ditolak. Undang-undang apa yang Karpal (Singh) belajar? Beliau adalah peguam kelas ketiga,” kata Nazri sambil ketawa.
Karpal sebelum ini berkata tindakan akan diambil ke atas Pandikar kerana menyalah-gunakan kuasa meluluskan usul menggantung Ketua Pembangkang, Datuk Seri Anwar Ibrahim dan tiga ahli parlimen yang lain, termasuk dirinya selama enam bulan.
Nazri juga menafikan dakwaan pembangkang, kononnya beliau mengarahkan Pandikar supaya menggunakan Peraturan dewan 44 untuk menghentikan perbahasan dan membuat undi tanapa perdebatan.
“Saya tidak beri arahan. Speaker telah peruntukkan dua jam dan saya kata saya mahu bacakan usul saya dahulu, itu sahaja.
“Apa yang mereka perkatakan tidak ada kena mengena dengan Aturan Urusan Mesyuarat hari ini. Jadi saya mempunyai hak kerana ia usul saya dan saya mahu ia dibentangkan.
“Saya cuma beritahu speaker saya mahu baca usul kerana ia dalam Aturan Urusan Mesyuarat. Mereka sepatut membantah tetapi tidak berbuat demikian,” katanya.

I think Nazri is right, because under our Perlembagaan it does state that under Article 63(1) - The validity of any proceedings in either House of Parliament or any committee thereof shall not be questioned in any court.
Tough luck Karpal, I think like the Judgement in The Ipoh High Court in September 2009 which struck out with costs the suit by Perak Pakatan Rakyat former legislative assembly speaker Sivakumar against sitting speaker R Ganesan, seeking damages for assault and battery and wrongful detention, as well as aggravated damages. Again this time Pakatan meek and time wasting attempt to bring the proceedings of Parliament to Court wil be thrown out for sure.
The Learned Judge struck out the suit based on quote "To me as far as this court is concerned, the decision of the legislative assembly on May 7, 2009 to remove the plaintiff as speaker and to appoint the defendant was conclusive and had been fairly determined by the state assembly on May 7, 2009. To question the validity of the removal and appointment is to question the validity of the constitution. This cannot be done in virtue of Article 72 (1) of the Federal Constitution[which states that the validity of any proceeding in any state legislative assembly cannot be questioned in any court].
This High Court judgement was later affirmed by the Appeals Court in June 2010.
Anyway the long suspensions could be good news for the ongoing Anwar sodomy trial that is Anwar(the accused) and Karpal(the lead defence counsel) do not have to ask for postponements because they have to attend to Parliament sessions.
Rest assured that there will be no snap elections in the next six months friends, BN would not be doing the same mistake of allowing Anwar to roam the country freely to do his ceramah as his suspension meant that he is free of Parliamentary duties. Anyway siapa mau ganti Anwar sebagai Ketua Pembangkang. I presume the real Ketua Pembangkang, Lim Kit Siang will takeover what is his rightful place by virtue of the DAP holding the biggest MP numbers in Pakatan anyway.
