Statement On National Reconciliation by YAB PM Najib Razak

At today’s cabinet meeting, my ministers and I examined a plan to develop and promote an environment which is conducive to and will help promote national reconciliation through unity and consensus in the country.

I had mooted this idea following the General Elections but various parties were not conducive to my appeals to come together. The legitimacy of the elections were even questioned by them and it was proven to be baseless. I am now heartened to see that the Opposition is calling for a consensus and I am sure that they will welcome this new development.

Unlike vague ideas about a consensus, the government’s national reconciliation plan will be based on four key thrusts namely, social, political, government and international relations and going forward, I will lead the implementation of changes that we hope will bring all Malaysians closer together.

The government’s plan is based on democratic principles and we will continue to defend the freedom to voice one’s views but this must also be tempered with responsibility. In order for all this to succeed, we must all commit to avoid spreading lies and slander, finally putting to rest the politics of hate.

There is also a need to go back to the grassroots and re-engage with the people to build their commitment to our common vision of a peaceful, successful and harmonious Malaysia. We must also get our youths involved in these initiatives to unite the people. We must work towards a Social Unity Model that can help ensure that unity remains a common objective in the activities of the next generation.

I must make it clear that these plans do not include the formation of any sort of unity government. We were given a strong mandate by the people to govern at the last General Elections and we intend to do so. However, we must look at becoming more inclusive in our activities and events. We are open to talking to all parties and we can use Parliament including the setting up of bi-partisan committees to discuss issues affecting national unity.

Over the next few months, you will see changes that will help make Malaysia a stronger, more united and cohesive nation. I invite all Malaysians to join me on this journey.

My Take:

1. Well, let me be perfectly frank, I hope that this National Reconciliation Plan is not another 1Malaysia which meant different things to different people.

2. I hope also that this plan does not mean appeasement of one whose grip on the economy has got to a point that it is becoming very counter productive to Malaysia's unity.

3. Those who commit to spreading lies and slander should be dealt with by the Polis who should be equipped with the necessary Laws to put them in jail, freedom of speech notwithstanding must have limits. Loose words will incite and cause hatred.

4. PM Najib can Start National Reconciliation now by declaring that any By Election not caused by the death of the incumbent or by a Court Order will not be participated by Barisan Nasional. This is to ensure that troublemakers cannot sodomise the electoral process for their own selfish greed be it political or personal. PM Najib should lead Malaysia away from these people the likes of Anwar and his bunch of hypocrites who thinks nation building is by way of politicking and forced bye-elections.

Well I guess every body now knows that that Anwar Ibrahim will be PKR candidate for the DUN Kajang bye election made necessary by the sudden resignation of PKR Adun, I don't remember what the fella's name, never mindlah he is just a pawn who has sold his honour to the devil, bid him goodbye and good riddance.

While the Azmin PKR camp is dead set on having Anwar to replace MB Khalid Ibrahim who has done a commendable job for Selangor and I must say better than many BN MBs previously, they all should read this noteworthy post by RPK which I am reproducing in full (It has part of the Selangor State Constitution as well):

I have noticed that many readers talk about the law and the constitution without reading what the law or constitution says and with absolutely no understanding of the matter. In fact, some are not even aware that states do have a constitution or have even ever seen one.
And this is why many people are making silly comments regarding the power and authority of Their Highnesses. These same people also make silly comments regarding two issues that have reached crisis proportions in Selangor — the Allah word crisis and the Menteri Besar crisis.
Maybe it is time you were given a lesson on the Selangor State Constitution before you continue to make foolish statements.
First read Article 48 of the Selangor State Constitution below.
Many of you argue that His Highness the Sultan of Selangor is the head of Islam, not the head of religion. This is not what Article 48 says. His Highness has the power and authority over all religions that may affect Islam. If His Highness is of the opinion that using the Allah word does affect Islam then His Highness has a say in that matter.
Article 53 says His Highness shall appoint a Menteri Besar. It is not the political parties that appoint a Menteri Besar but His Highness that does so. The appointment of the Menteri Besar is based on the discretion of His Highness although in most instances His Highness will take into consideration and respect the wishes of the people of Selangor.
If, however, the Menteri Besar faces a vote of no confidence in the State Assembly, then the Menteri Besar shall tender his resignation unless the Menteri Besar requests that His Highness dissolve the State Assembly to make way for fresh state elections (due to the vote of no confidence).
In other words, the Menteri Besar need not resign. He can request that His Highness dissolve the State Assembly so that the matter can be brought back to the voters to decide.
Article 55(2) of the Selangor State Constitution spells out the powers and authority of His Highness the Sultan and in what situations His Highness can use his discretion (2)(a) to (2)(g).
So there you have it. Do more reading before you start commenting about things you know very little about. And note one thing, His Highness is a Constitutional Monarch, not a Puppet on the throne. So do not assume that His Highness has no power and authority and must do as he is told.



Win or lose in the by election, I think Anwar will meet his political Waterloo in PRK DUN Kajang.

Oh and yes.....Jangan salahkan UMNO ok..... its so not cool.

'Konsensus Nasional' - Anwar should get his messy party in order and accept the result of the 13th General Election first

YB Zahid Hamidi should have got consensus before he recommend Anwar's 'National Consensus' to the YAB PM, the YAB PM too should seek consensus with the UMNO's MT before talking to the Cabinet about Anwar's offer which by his tricky past, is likely a Trojan Horse designed to look pretty but in reality will mess up everything that goes on in this country. 

Anwar is responsible for the disunity between the Malays and its no secret that is why the DAP is keeping him as Opposition Leader specifically to keep the Malays disunited so that DAP is strong and can be the ultimate kingmaker in Malaysia's politics. If you don't know this then please just go to work enjoy your salary go on holiday don't bother about politics in Malaysia.

Ahmad Zahid menerima baik tawaran Datuk Seri Anwar Ibrahim, tetapi bagi Pengerusi Kelab Penyokong Barisan Nasional (BNBBC) itu, PR perlu terlebih dahulu menunjukkan keikhlasan sebelum menawarkan sebarang konsensus nasional dengan kerajaan.

"Itu pandangan dia, pandangan saya lain," kata Shahrir kepada The Malaysian Insider merujuk kepada kenyataan Zahid yang mengalu-alukan saranan Anwar.

"Orang yang buat kacau, dia (Anwar) betulkan tempat dia dulu, dia punya sendiri. Kalau kita pun sama terlibat dalam benda ini, orang kita pun sendiri, kenalah tegah orang kita dahulu," katanya.

Anwar yang juga ketua pembangkang pada Ahad lalu sekali lagi mengulangi cadangan mewujudkan konsensus nasional dengan kerajaan Barisan Nasional (BN) walaupun cubaannya sejak selepas pilihan raya 5 Mei masih belum membuahkan hasil.

"Mereka (pembangkang) boleh menunjukkan keikhlasan, bukan hanya tunjuk hendak rekonsiliasi nasional sahaja.

"Mana yang Anwar boleh kawal, dia patut buatlah. Janganlah nak rekonsiliasi tapi orang dia provok seperti Adun PKR buat demo kangkung tidak senonoh. Apa keikhlasan dan asas hendak rekonsiliasi macam itu?" kata Shahrir merujuk kepada demonstrasi kangkung Ahli Dewan Undangan Negeri (Adun) Machang Bubuk, Lee Khai Loon.

Shahrir yang juga bekas anggota Kabinet di zaman pentadbiran Tun Abdullah Badawi berpendapat Anwar tidak layak untuk bercakap tentang konsensus nasional.

"Saya lagi skeptikal, Anwar cakap rekonsiliasi nasional sudah banyak kali.

"Saya ketawa sahaja. Adakah mereka yang sepatutnya meminta rekonsiliasi nasional," katanya.

Anwar dilihat serius apabila sekali lagi membuat tawaran perbincangan konsensus nasional dengan BN pada Ahad, tiga hari selepas gesaan sama dikeluarkan beliau sebelum itu.

Anwar sebelum ini membuat jemputan sama kepada Putrajaya bagi menyelesaikan kemelut berkenaan ekoran beberapa siri demonstrasi dan tindakan rakyat yang agak keterlaluan sehingga dikhuatiri mencetuskan ketegangan kaum dan agama.

Pilihan Raya Umum ke-13 (PRU13) menyaksikan BN mendapat keputusan lebih buruk, hilang tujuh lagi kerusi Parlimen berbanding pada 2008 selain gagal untuk merampas kembali majoriti tradisi dua pertiga di Dewan Rakyat.

Perebutan berhubung penggunaan kalimah Arab Allah oleh penganut Kristian dan Islam menguji pentadbiran Najib.

Selain itu, penyelarasan subsidi serta kenaikan harga barangan dan perkhidmatan menambahkan lagi kemarahan ramai pihak kepadanya.

PR mengkritik pendirian kerajaan dalam isu menyentuh poket rakyat dan pendirian kerajaan dalam isu kalimah Allah.

"Saya rasa mereka (pembangkang) kena berhenti perang dahulu, jangan menyerang benda yang bukan-bukan.

"Sebelum itu, kalau masih teruskan pelbagai provokasi, buat demonstrasi dan sebagainya, siapa hendak percaya," katanya.

BN berjaya memperolehi 133 kerusi daripada 222 kerusi Parlimen pada PRU13 lalu berbanding PR yang hanya memperolehi 89 kerusi.

Bagaimanapun, buat pertama kali dalam sejarah BN kehilangan undi popular apabila hanya mendapat 47% berbanding PR yang mendapat 51%. - 28 Januari 2014.

Kalimah ALLAH issue: Lets listen to the voices of reason and impartiality

REFLECTING ON THE LAW

It is not always right to use our rights. In matters of religion, history, logic and reason must not apply exclusively. Emotions must be regarded.

THE desecration of several places of Christian worship must be condemned as a shameless and mindless atrocity. A democratic society does not resolve disputes through violence.

It is obvious that we have in our midst a lunatic fringe that has no understanding of religion or of the Constitution or of the traditions of tolerance and multi-culturalism that made Malaysia an exemplar for all other plural societies.

In the midst of gloom it is heartening to note that a large number of Muslims, including the Prime Minister, have joined grieving Christians to condemn this outrage.

Church leaders have shown exceptional restraint and have been true to their faith by condemning the sin but forgiving the sinners.

We have to put this national shame behind us and to move on to resolve the “Allah issue” in a spirit of compassion, moderation and accommodation.

Through the looking glass of the Christians, I can clearly see that although the word Allah has obvious reverence for Muslims, no one can deny that Allah is also a term of language.

For centuries, in the whole of Arabia, followers of all semitic religions have used the word Allah to refer to their own God. Arab-speaking Christians use Allah al-ab (God the father), Allah al-ibn (God the son), Allah al-quds (God the Holy Spirit).

Such transcendence of common symbols and vocabulary must be commended, not condemned. In any case the Muslim belief in one and only one God necessitates acceptance that Allah is for everyone and not just for Muslims.

There is also the constitutional dimension of freedom of religion in Article 11(1) and the right to free speech in Article 10(1)(a). These Articles are broad enough to permit any one to invoke whatever language or sentiment he wishes to invoke in order to open his heart and soul to God.

Muslim leaders must also acknow­ledge their role in this imbrogilo. They banned local translations of the Bible into Malay. This forced Malay-speaking Christians, especially in Sabah and Sarawak, to import Bibles from Indonesia.

Bibles in Bahasa Indonesia use Allah to refer to the Christian God.


The Muslim argument that use of the word Allah by non-Muslims will confuse the Muslim population is demeaning.

It paints the Muslims as an extremely ignorant and gullible lot. It ignores the fact that Islam took deep roots in Malaya hundreds of years ago and became the identifying feature of the Malay persona.


The Islamic faith was not shattered during British rule. Why should it be so easily shaken now after 52 years of Muslim rule, 52 years of Islamic education and a vigorous dakwah movement?

However, looking at the issue through Muslim lenses, many issues tug at my conscience. First, it is not always right to use our rights. Freedom per se has no value. It is what freedom is for. It is the use to which it is put. It is the sense of responsibility and restraint with which it is exercised.

Take the one hundred million Muslims in India for example. Despite their rights in secular India’s Constitution, they refrain from butchering the cow because the cow is regarded as sacred by the majority Hindus.

In the British case of Humphries vs Connors, 1864, a Protestant lady was marching in a predominantly Catholic area with an orange lily in her buttonhole. For historical reasons that evoked painful memories for the Catholics.

A police constable plucked the lily away. In an action against the officer for assault, the court held that the officer was within his duty to prevent breaches of the peace.


Similar considerations apply in Malaysia. The constitutional right to freedom of religion is subjected by Article 11(4) to restrictions on proselytisation. Article 11(5) subordinates religion to public order, public health or morality.

A relevant law on public order is section 298 of the Penal Code which punishes the offence of wounding religious feelings.

These feelings are likely to be wounded if there is a claim that Allah was born in the manger; that Allah was born of Mary; that Allah was crucified on the cross.

The Muslim doctrine is that Allah does not beget and cannot be begotten. He cannot be depicted in any physical form. He cannot be part of the Trinity of Father, Son and Holy Ghost.

To argue that the word Allah is central to the Christian faith and that any restriction on its usage would hinder freedom of conscience of the Christians requires a willing suspension of disbelief.

Other than in the Arab Peninsula and in Sabah and Sarawak, the word Allah has never been part of Christian discourse or sermons. Certainly in west Malaysia the word was not part of Christian vocabulary up to now.

The Herald’s new found love for Arabic words is indeed very touching but one cannot fail to note that the import of Arabic words is rather selective.

Tan Sri Dzulkifli of USM has pointed out that in the Malay translation of the Bible, the word Allah is used to refer to the Lord God but Mary, Abraham, Moses, Joseph, Michael and other revered figures are not given their Arabic names.

One must also remember that Malaysia is not Arab-speaking and Christian sermons in Malay could just as well use words like Tuhan, Dewa, Dewata and Betara without any diminution of freedom of conscience.

The plaintiffs in the Herald case must also take note that there is suspicion, unjustified though it may be, that the use of the word Allah is an indirect attempt to proselytize Muslims contrary to Article 11(4).

The argument that the Church will be using the word Allah only privately is credible but we all know that it does not take much to put a private publication in the public domain.

All in all it can be said that in relation to the Herald case, the general Muslim reaction is too emotional and is based on lack of knowledge.

The Herald, on the other hand, has lots of facts but no tact. Its arguments rely on cold logic, history and rationality but there is total disregard of local context and of religious sensitivities.

It is submitted that in matters of religion, history, logic and reason must not apply exclusively. Emotions must be regarded. Sometimes rights must give way to the need for social harmony. We need to find a middle path.

The case of Sabah and Sarawak Christians who have a long tradition of using the word Allah without any inter-religious problems needs to be sympathetically considered.

In the long range, encouragement must be given to replace Indonesian translations of the Bible with Malaysian renditions. All restrictions on the printing of Bibles in the Malay language must be lifted.

In relation to west Malaysian Christians, there is no need to use the sledgehammer of the Printing Press­es Act to impose prior restrai­nts. A Home Ministry advice on the consequences of violating Articles 11(4), 11(5) and section 298 of the Penal Code will be sufficient. If this advice is not followed, prosecutions can be commenced.

The judicial process should be allowed to continue without any intimidation. However neither judicial decisions nor executive proclamations can make this heart-wrenching problem go away.

We need inter-faith dialogue to find comprehensive political and administrative solutions for our tattered fabric of inter-religious relationships. There are many painful issues and piece-meal solutions will not be enough.

Fair and moderate solutions will require leadership and sacrifice. As the Rev Jesse Jackson said “leaders of substance do not follow opinion polls; they mould opinion, not with guns or power of position but with the power of their souls”.


By now everyone knows that the High Court decision which allowed Herald Magazine to use the word ALLAH in their publication went to the Court of Appeal and was subsequently overturned, triggering another round of debates and with the recent JAIS raid in Selangor on a bookstore selling Bibles, things are heating up and the temperatures in Semenanjung are going up no thanks to the extremist shit stirrers in the DAP read here. (thank God Almighty that the Sabah and Sarawak people are taking things in their stride not unduly influenced by DAP incitement)

This is what the good Professor wrote recently on 23 January 2014 in regards to the Kalimah ALLAH issue that threatens to tear our blessed nation apart:

We need to sit down with humility and maturity at the table of fellowship for a dialogue.

ON Prophet Muhammad’s birthday it was heartening to hear the clarion call by the Yang di-Pertuan Agong, the Ruler of Negri Sembilan and the Raja Muda of Perak for accommodation and tolerance on issues of religion.

Their sentiments are in line with Islam’s recognition of religious pluralism and its affinity with Judaism and Christianity. It is said in Surah 29:46: “And say: We believe in that which has been revealed to us and revealed to you. And our God and your God is one; and we are Muslims [in submission] to Him.”

Abu Dawud reports that Prophet Muhammad once warned his people: “Whoever is cruel and hard on a non-Muslim minority, or curtails their rights, or burdens them with more than they can bear, or takes anything from them against their free will; I will complain against the person on the Day of Judgment.”

I wish that on the Kalimah Allah issue, a spirit of respectful dialogue with humility and maturity could replace the shrill voices of discord and threats that have characterised the debate in the last few weeks.

If we could calmly listen to each other and try to understand each other’s fears and suspicions, we could arrive at some broad agreements.

In fact, a middle path already exists in the assiduously arrived-at Ten-Point Agreement of April 2011.

We need to honour this solemn pact and do whatever is necessary legally and politically to overcome the obstacles that stand in the way. The obstacles are indeed many.


Exclusivity: 
Many Muslims are claiming that the word Allah is exclusive to Islam and for this reason its usage by others must be banned.

This argument is based purely on local laws and on local perceptions. It has no theological, etymological or global basis.

The term Allah precedes Chris­tianity and Islam and is widely employed by Arabs of all faiths.

The Guru Granth Sahib of the Sikhs uses the term 46 times! Christians in Indonesia and in Sabah and Sarawak have for centuries invoked the term Allah to refer to God. Having said that, it must be pointed out that the concept of Allah, as shaped by Islam for 1,435 years, is radically different from the concept of god in most denominations of Christianity.

Wounding religious feelings: 
In the theology of Islam, Allah cannot be depicted in any human form. Allah cannot be an aspect of the trinity of Father, Son and Holy Ghost. Allah does not beget and cannot be begotten (Surah 112:3). There is a clear distinction between God Almi­ghty and His many noble Prophets.

That being so, if it were to be preached publicly that Allah was born of Mother Mary; that Allah was born in the manger; that He was crucified and resurrected, this will blaspheme Islam and could be caught by Section 298 of the Penal Code. There will be implications for public order.


Proselytisation:
I believe that the unspoken factor behind the Kalimah Allah dispute is the fear in some Muslim minds that Christian evangelical groups in peninsular Malaysia are using the word Allah to circumvent the restriction in Article 11(4) on converting Muslims. This suspicion must be addressed.

State laws: 
Article 11(4) authorises state assemblies to enact legislation to regulate the preaching of religion to Muslims. Ten states plus the Federal Territory have such laws in place. Till these laws are repealed or amended by the state authorities or nullified by the courts, their provisions will override the admirable 10-point solution.

I must add that some provisions of state laws enacted under Article 11(4) appear as unconstitutional as can be. The spirit of the Constitution in Article 11(4) is to forbid any att­empt to proselytise Muslims to other faiths.

Nine of the state laws resort to overkill by banning the usage of a number of Muslim or Arabic words without linking the usage to any attempt at proselytisation.

Even if the words are used in private, or to followers of one’s own faith, the usage is outlawed.

This appears unconstitutional. It would be useful to move the Federal Court for a ruling on this issue as to whether various state enactments under Article 11(4) are partly or wholly contrary to the Constitution.


State Rulers: 
Many state rulers, acting on advice, have relied on state enactments to issue edicts against the use of the word Allah by non-Muslims. However, questions of constitutionality of the legislation cannot be prevented from reaching the Federal Court.

Schedule 9, List 2, Para 1: 
The Constitution specifically asserts that Syariah courts have jurisdiction only over persons professing the religion of Islam. It is arguable therefore that Syariah authorities likewise have juri­s­diction only over Muslims. It is my submission that to the extent that state laws under Article 11(4) are addressed to non-Muslims, these laws are civil laws and are enforceable only by civil authorities in civil courts.

The Herald decision: 
The Court of Appeal decision contains sweeping statements that may adversely affect Sikhs, Christians of Sabah and Sara­wak and other parties that had no opportunity to submit their case before the court.
Hopefully, the Federal Court will confine The Herald decision to the facts of the case and to the parties involved. Hopefully all state laws under Article 11(4) will be interpre­ted narrowly to relate only to proselytisation.

There should be close examination of the Court of Appeal’s attempt to subordinate Article 11 (freedom of religion) to Article 3 (Islam). In this context, Article 3(4) should be taken note of: “Nothing in this Article derogates from any other provision of the constitution”.

A line of court decisions including the Halimatussaadiah and Herald cases imply that freedom of religion is restricted to essential and integral parts of the religion. Surely this is not so. Whatever is permitted, even if not mandated, is a fundamental right.


All in all, it is submitted that there is no issue that is so intractable that it cannot be resolved. We all need to sit down at the table of fellowship. I am encouraged by the Quranic inj­unction in Surah 29:46: “And do not argue with the People of the Scripture except in a way that is best.”

DYMM Agung's words must be respected and followed, does not matter if you are Malay, Chinese, Indian, Dayak, black or white you are Malaysian!



To those smart alecs who keep on saying that the Agung's word are advisory just because you don't agree with his speeches think again:

If you don't agree, jangan mulut macam longkang telling all and sundry that The Agung's words are advisory that applies to the learned lawyers too! Don't agree, show that you really mean it by returning the Passport to the Malaysian Government! Go to another country like a pendatang haram and see how the US, Australian or European treat you.

Salam Maulidur Rasul, jom berdakwah

The kalimah ALLAH issue has not abated in Malaysia, everyday there are many commentaries and speeches and news in the papers about the use and misuse of kalimah ALLAH by Muslims and Christians and some DAP politicians whom I do not know their religion.

I do not want to talk about it any more, suffice to advise my brothers and sisters in Islam that if a Christian or non Muslims approaches you and say that his God is ALLAH, let us rejoice, now tell them to complete the Syahadah and tell them to continue and say Muhammad is their prophet.

I hope those Selangor State Gomen Excos and Catholic Church Supporters take time to read this well written and measured media statement from MAIS beside the divisive tirades by Lim Kit Siang and his DAP cohorts and of course those smart Muslims like Mujahid and Marina and members of the learned NUCC too:

Kenyataan media ini dibuat bagi menjelaskan tindakan yang telah diambil oleh pihak JAIS sebagai badan penguatkuasa undang-undang Islam di negeri Selangor.
MAIS menegaskan bahawa tindakan yang dilakukan oleh JAIS pada 2 Januari 2014 dengan memasuki premis perniagaan di Damansara Kim atas nama Bible Society of Malaysia, Petaling Jaya seterusnya menyita sebilangan jumlah kitab Bible (Al-Kitab) versi Bahasa Melayu termasuk naskhah cetakan Bahasa Melayu Injil Lukas yang tertera kalimah Allah adalah selaras dengan kuasa yang diberikan di bawah undang-undang khususnya di bawah Enakmen Ugama Bukan Islam (Kawalan Perkembangan di kalangan Orang Islam) 1988 (selepas ini dirujuk sebagai  Enakmen 1988).
Tindakan JAIS adalah satu tindakan pemeriksaan dan penyiasatan setelah aduan orang ramai diperolehi berkaitan dengan kegiatan penerbitan kitab Bible (Al-Kitab) yang menggunakan kalimah Allah di dalam kitab Bible (Al-Kitab) berkenaan yang merupakan suatu kesalahan di bawah Seksyen 9 Enakmen 1988.
Pihak JAIS mempunyai kuasa melakukan tindakan pemeriksaan dan penyiasatan walaupun melibatkan orang bukan Islam oleh kerana Enakmen 1988 adalah terpakai bukan sahaja kepada orang Islam tetapi orang bukan Islam juga dan peruntukan Seksyen 12 Enakmen 1988 yang dibaca bersama Jadual di dalam Enakmen 1988 berkenaan jelas memberi kuasa kepada pihak JAIS disamping pihak polis untuk melakukan penyiasatan.
MAIS juga menegaskan bahawa tindakan JAIS bukan atas dasar cetakan Bible berkenaan di dalam versi bahasa Melayu tetapi atas dasar kalimah Allah telah digunakan di dalam Bible berkenaan dan ini mengundang kepada satu justifikasi siasatan bagi  mengenalpasti samada berlaku satu kesalahan di bawah Seksyen 9 Enakmen 1988. Malangnya pihak media termasuklah kenyataan Pengerusi National Unity Consultative Council (NUCC) seperti yang dilaporkan dalam akhbar semalam telah melaporkan fakta yang tidak tepat sama sekali bagi menggambarkan seolah-olah tindakan JAIS adalah semata-mata kerana cetakan Bible berkenaan adalah di dalam versi bahasa Melayu. Tindakan pihak- pihak berkenaan amat dikesali kerana mereka telah membuat kenyataan tanpa menyemak fakta yang sebenar. Ini  menyebabkan salah tanggapan masyarakat terhadap tindakan pihak JAIS.
Di samping itu, pihak MAIS juga menegaskan bahawa JAIS tidak perlu memaklumkan kepada mana-mana pihak apabila ingin mengambil sesuatu tindakan pemeriksaan dan penyiasatan kerana ini akan mengganggu proses penyiasatan yang hendak  dilakukan. Walau bagaimanapun tindakan pihak JAIS ini dilakukan setelah pihak MAIS mengambil penegasan di dalam mesyuarat bulanan MAIS agar pihak JAIS mengambil tindakan terhadap aduan orang ramai berkaitan dengan kesalahan-kesalahan di bawah Enakmen 1988 ini atau dengan kata lain  menguatkuasakan undang-undang yang sedia ada di Selangor.
Tindakan JAIS ini hendaklah jangan disalah anggap sebagai satu tindakan yang bersifat menyekat atau campur tangan terhadap kebebasan beragama oleh penganut-penganut agama lain sepertimana peruntukan Perlembagaan Persekutuan. Ini adalah kerana tindakan JAIS sekadar menguatkuasakan satu undang-undang yang sedia ada yang telah digubal menurut peruntukan Perkara 11(4) Perlembagaan Persekutuan. Oleh itu, ianya tidak ada kena mengena dengan unsur-unsur menyekat kebebasan penganut agama lain daripada melaksanakan amalan agama mereka. JAIS tidak langsung mengambil tindakan menyekat orang-orang yang beragama Kristian dari melaksanakan upacara keagamaan mereka seperti yang diperuntukan di dalam  Perlembagaan.
Adalah juga diingatkan kepada orang awam bahawa di samping Enakmen 1988 mengenai pengawalan penggunaan kalimah Allah, terdapat juga fatwa oleh Jawatankuasa Fatwa Negeri Selangor yang telah diwartakan pada 18 Februari 2010 yang melarang penggunaan kalimah Allah oleh agama-agama bukan Islam yang lain. Malah fatwa Jawatankuasa Negeri ini konsisten dengan keputusan Muzakarah Jawatankuasa Fatwa Majlis Kebangsaan Bagi Hal Ehwal Ugama Islam Malaysia kali ke-82.
Di samping itu, Mahkamah Rayuan di dalam kes Menteri Dalam Negeri & 8 Yang Lain lawan Titular Roman Catholic Arcbishop of Kuala Lumpur (Rayuan Sivil No. W-01-1-2010) telah memutuskan pada 14 Oktober 2013 bahawa penggunaan kalimah Allah di dalam agama Kristian akan menyebabkan kekeliruan di dalam masyarakat dan kalimah Allah bukanlah merupakan asas atau tunjang utama kepada kefahaman agama Kristian. Keputusan kes ini walaupun sedang menunggu rayuan di Mahkamah Persekutuan setakat ini keputusan berkenaan mengikat semua pihak di Negara ini.
Berikutan dengan Fatwa yang dikeluarkan di peringkat Negeri dan Kebangsaan serta keputusan Mahkamah Rayuan dengan juga mengambil kira peruntukan undang-undang di bawah Enakmen 1988, Duli Yang Maha Mulia Sultan Selangor sebagai Ketua Agama Islam negeri Selangor setelah berunding dengan Dewan di-Raja Selangor telah memutuskan agar setiap tindakan yang bakal diambil oleh badan penguatkuasaan agama negeri Selangor perlulah selaras dengan peruntukan undang-undang yang sedia ada yang terpakai di negeri Selangor khususnya Enakmen 1988.
Dengan penjelasan ini, MAIS meminta orang ramai tidak mengambil kesempatan untuk mempolemikkan isu ini agar penyiasatan dapat dijalankan tanpa sebarang tekanan dari mana-mana pihak demi mencapai matlamat penyiasatan yang adil dan efektif.

Does views of the NUCC on #JAIS raid meant that its members be reviewed to reflect realities in Malaysia?

The NUCC waded into the controversy on the JAIS raid on the the Bible Society of Malaysia which is basically a storage and book distribution centre and not a place of worship as some folks with not so nice agendas wanted to portray it:

What is the 10-Point Deal really? Is it policy or Law? Very important to note because the JAIS raid on the BSM book distribution centre was based on Law namely section 9 of Selangor’s Non-Islamic Religions (Control of Propagation Among Muslims) Enactment 1988. We are a nation ruled by Law kan?

As we are all aware, the impounding of the Bible in Bahasa Malaysia/Indonesia has triggered concerns and tensions within the country which we have to address urgently to prevent these from escalating any further. Consequently, we have been in discussion with the Christian Federation of Malaysia and other Christian groups to resolve the Bahasa Malaysia/lndonesia Bible and also other religious issues. Taking into account the polarity of views of the different religious groups, including Christians and Muslims, the Government decided on a Ten Point Solution. 

On 2nd April 2011 the Government announced a Ten Point Solution to address the Bible issue and other related issues. I wish to confirm that this is a collective decision by the Cabinet. 

The Ten Point Solution is as follows: 

1. Bibles in all languages can be imported into the country, including Bahasa Malaysia/Indonesia. 

2. These Bibles can also be printed locally in Peninsula Malaysia, Sabah and Sarawak. This is a new development which should be welcome by the Christian groups. 

3. Bibles in indigenous languages of Sabah and Sarawak such as Iban, Kadazan¬Dusun and Lun Bawang can also be printed locally and imported. 

4. For Sabah and Sarawak, in recognition of the large Christian community in these states, there are no conditions attached to the importation and local printing of the Bibles in all languages, including Bahasa Malaysia/ Indonesia and indigenous languages. There is no requirement for any stamp or serial number. 

5. Taking into account the interest of the larger Muslim community, for Peninsula Malaysia, Bibles in Bahasa Malaysia/Indonesia, imported or printed, must have the words “Christian Publication” and the cross sign printed on the front covers. 

6. In the spirit of 1Malaysia and recognising that many people travel between Sabah and Sarawak and Peninsula Malaysia, there should be no prohibitions and restrictions for people who bring along their bibles and Christian materials on such travel. 

7. A directive on the Bible has been issued by the Ketua Setiausaha (KSU) of the Home Ministry to ensure proper implementation of this cabinet decision. Failure to comply will subject the officers to disciplinary action under the General Orders. A comprehensive briefing by top officials, including the Attorney General (AG), will be given to all relevant civil servants to ensure good understanding and proper implementation of the directive (See Attachment 1). 

8. For the impounded Bibles in Kuching, Gideon, the importer can collect all the 30,000 Bibles free of charge. We undertake to ensure the parties involved are reimbursed. The same offer remains available for the importer of the 5,100 Bibles in Port Kiang, which have already been collected by the Bible Society Malaysia (BSM) last week. 

9. Beyond the Bible issue, the Government wishes to reiterate its commitment to work with the Christian groups and all the different religious groups in order to address interreligious issues and work towards the fulfilment of all religious aspirations in accordance with the constitution, taking into account the other relevant laws of the country. In order to bring urgency to this work, in my capacity as the Prime Minister, I will meet the representatives of the Christian Federation of Malaysia (CFM) soon to discuss the way forward. 

10. The Christian Ministers in the cabinet will meet on a regular basis with representatives of the various Christian groups in order to discuss their issues and work with the relevant Ministries and myself in order to resolve them. As the leader of this country, I wish to reiterate the Government’s commitment in solving any religious issues in this country. There is a need to manage polarities that exist in our society to achieve peace and harmony. I believe the best way to achieve this is through respect, tolerance, forgiveness and reconciliation.

The 10 point solution does not include the kalimah ALLAH and I hope that the learned people at the NUCC be very clear about that, so is the fact that the the Bible Society of Malaysia Book Distribution Centre is NOT a place of worship and that JAIS is acting based on Law and the 10 point solution is a policy. Laws will always over rule policy!

Muslim groups rap NUCC for censuring Jais over seizure of Bibles

Some Muslim groups have hit out at the National Unity Consultative Council for censuring the Selangor Islamic Religious Depatment (Jais) on its seizure of Bibles containing the word Allah from the Bible Society of Malaysia (BSM) last week.

Speaking on behalf of a coalition of nine pro-Umno Muslim NGOs, Perkasa deputy president Datuk Zulkifli Noordin (pic) said the NUCC’s disapproval was a transgression of natural justice as Jais had acted according to the law.

He said the NUCC should have allowed Jais to explain its action.

He also said that the enforcement body did not seize Bibles per se, but had only seized publications which contravened section 9 of Selangor’s Non-Islamic Religions (Control of Propagation Among Muslims) Enactment 1988.
"It so happened that the publications were Bibles," Zulkifli said at a press conference today.

He added that the offence under the enactment came under civil law and was not under syariah jurisdiction, as such, it applied to non-Muslims as well.

Zulkifli also said that the contention by NUCC that the seizure went against the 10-point solution was wrong, as the 10-point solution did not cover the use of the word Allah.


"Nothing in the 10-point resolution says that Malay Bibles can contain the word Allah. It merely says that Bibles in Malay can be imported," he added.

When pointed out that the Home Ministry had given its stamp of approval for the imported Bibles, Zulkifli reiterated that it did not mean the Home Ministry had approved of the word Allah in the Bibles.

"The government allows the Bibles to be imported, but any imported material must comply with the laws in the country.

"And having the word Allah means the importer and the distributor are the ones who have not complied with the law.

"Jais is not wrong in its actions, although it is being made out to be so by the NUCC," he said.


He added that the perception that the unity council was controlled by certain groups of people was cause for concern.
As such, he appealed to the NUCC to change its approach in dealing with inter-faith matters.

"To us, NUCC has failed to carry out their duties in a mature and professional manner in ensuring justice for all.

"Why is the issue not being looked at from the perspective of the Muslim community? Have we lost our right to defend our right to profess and practise our faith," he asked.
Perkasa information chief Muhammad Zahid Md Arip, meanwhile, said the NUCC should include ulama as members.

"What we have now is Ustazah Marina Mahathir in the council," he said.


Zulkifli noted that the 10-point solution was merely a policy while the Selangor enactment was law.

"It is basic legal knowledge that law is above policy.

"If you cannot learn to respect the law, then I don't know if you are fit to be in this country," he added.

Zulkifli also questioned the Selangor government's silence over the matter.

He warned all parties to behave in a rational manner to preserve harmony among the different religions in the country.

"Don't allow this to be destroyed by the desires of certain people who do not understand nor respect the sensitivity of others," he added. – January 7, 2014.

The JAIS controversy showed that the NUCC membership needs to be reviewed, the majority Malay/Muslims are under represented and should in fact reflect the demographics of this country, if not how could it become a bridge between races and faiths if minority imposes their will and run roughshod over the majority thru the NUCC?
