Does some in Janjibersih wants to "Wage a war against the Yang DiPertuan Agung"?

I noticed something very disturbing from the various Pro PR and PRO BN blogs reports on the illegal gathering by the JanjiBersih crowd at Dataran Merdeka last night.

Some in the Janjibersih crowd unfurled  flags very much similar to the flags of the republic of Indonesia and the Republic of Singapore, both countries without Monarchs as their Head of State:

I thought the flag was just a prank by some Janjibersih crowd to create attention to themselves BUT Now here is the disturbing part, this kind of pamphlet  were distributed at Dataran Merdeka:

For 55 years since Merdeka there has never been such blatant disrespect to the Jalur Gemilang a symbol of this sovereign nation we call Malaysia. Our soldiers and police officers died and lost their limbs in defence of this nation under the Jalur Gemilang flag, We celebrated our achievements in sports and other matters with the Jalur Gemilang. The Jalur Gemilang is the national symbol of this sovereign and independent nation.

I do not know what their intention are in wanting to change the Jalur Gemilang but if they think that they want to change Malaysia to a Republic like Singapore or Indonesia then they will have to go through very many pissed off Malaysians who swears their loyalty to the Yang diPertuan Agung and Raja-Raja Melayu and this blessed Country.

In fact the people behind the pamphlet to change the Jalur Gemilang should be investigated by the authorities, They could have intentions to Wage War Against the Yang DiPertuan Agung you know. Refer here.

I will not submit to Hudud "a la" PAS

I will not submit to PAS's version of Hudud:

Kelantan PAS deputy commissioner Datuk Mohd Nik Amar Nik Abdullah said: 
Although only applicable to Muslims, it will be ideal if non-Muslims one day accept hudud and Islam jurisprudence towards the creation of a just society.”

According to PAS's version of Hudud, if Anwar, Lim and Karpal are caught stealing, Anwar will have his hand cut off while Lim and Karpal will be sent to jail. This is not fair. Islam is fair but PAS's version of Hudud is unfair. 

If PAS wants to implement Hudud, then it must be applicable to Muslims and Non-muslims alike. There cannot be two systems of criminal punishment in this blessed country, it will bring utter chaos. 

PAS using Hudud as a political weapon is divisive and smacks of hypocrisy.

Friends, let us tell PAS that their Hudud version is unfair, Do not vote for PAS or their loose coalition partners DAP and PKR this Pakatan of different political idealogies will bring utter chaos to this country with DAP dead against Hudud and PAS believing that the Pakatan can agree to disagree about Hudud and PKR just looking on like idiots.

The Devil wears Prada and why we should not take things literally

To all those shallow brained wannabee politicians like Nurul Izzah and the like who takes things literally, now please pay attention, this is a short English lesson:

When Dr. Mahathir said "better the devil you know than the angel you don't" he was referring to an old English idiom which meant "that it is often better to deal with someone or something you are familiar with and know, even if they are not ideal, than take a risk with an unknown person or thing". 

Is the main character in this movie a devil?

Of course not!

We should not take things literally, but then in Pakatan style politics anything goes, they try to gain votes by demonizing the Ruling BN and giving out free promises, that is what they are good at creating chaos, make promises they know they cannot deliver and arguing among themselves about Hudud etc. 

A vote for DAP, PKR and PAS is a vote for chaos and a politically unstable Malaysia. Its a vote for regression into a failed state led by ex-convicts (Anwar and Guan Eng).

20 OGOS — Selepas 55 tahun selepas Merdeka, rakyat Malaysia masih belum mencapai kata sepakat tentang identiti negara tercinta ini. Ia bukan sesuatu yang luar biasa. Kebanyakan negara lain, terutamanya yang berbilang kaum dan agama, menghadapi cabaran yang sama.

Bagi negara-negara yang mempunyai status berbilang kaum akibat daripada proses penjajahan, cabarannya jauh lebih rumit jika dibandingkan dengan negara-negara yang memperolehi ciri-ciri berbilang kaum melalui penaklukan atau integrasi wilayah mahupun penerimaan pendatang dari luar yang ditentukan oleh elit pribumi negara itu sendiri.

Sebagai contoh di Malaysia, para Sultan Melayu tidak terlibat di dalam membuat keputusan untuk menerima ratusan ribu pendatang dari China dan India dalam kurun 19. Pihak penjajah British yang bertanggungjawab ke atas penghijrahan ini untuk kepentingan ekonomi kolonial mereka.

Justeru, sistem ekonomi yang wujud dari kurun 19 memperlihatkan pengasingan kaum Cina dan India dalam gelanggang ekonomi masing-masing daripada bangsa Melayu yang terus terikat dengan ekonomi desanya dan sistem pentadbiran kesultanan-kesultanan Melayu.

Pengasingan ini membawa implikasi besar kepada sistem pendidikan, corak hidup sosial dan alam budaya kaum-kaum yang menetap di negara ini. Kesan-kesan negatif daripada sejarah kolonial ini boleh dirasai sehingga ke hari ini.

Mungkin dampak yang paling serius adalah dalam sikap dan pandangan sebahagian besar kaum Cina dan India terhadap identiti diri mereka dan identiti Malaysia.

Untuk memahami cabaran ini, kita harus merenung kembali sejarah identiti kelompok-kelompok Cina yang berhijrah ke Tanah Melayu pada kurun 15 dan selepasnya — iaitu sebelum zaman kolonial British — dan cara mereka menyesuaikan diri dengan persekitaran keMelayuan.

Walaupun kelompok-kelompok ini kekal dengan agama Buddha, bahasa dan budaya tempatan mudah diserap kerana mereka mahu menyesuaikan diri dengan budaya dan masyarakat induk yang dikuasai sistem kesultanan ketika itu.

Pada zaman kolonial, sebagai bangsa terjajah, Melayu hilang kedudukan puncaknya.

Manakala, kelompok-kelompok Cina yang bermastautin di Melaka, Terengganu dan Kelantan pada masa itu adalah dalam jumlah yang kecil .

Latar belakang sejarah ini telah mempengaruhi sebahagian daripada perspektif tentang identiti negara dan penduduknya selepas kemerdekaan. Pada keseluruhannya, kita dapat mengenalpasti tiga perspektif.

Pertama, sebahagian daripada masyarakat Melayu menganggap Malaysia adalah sebagai negara Melayu. Dari segi fakta sejarah tidak dapat disangkal, kesultanan Melayu merupakan teras sistem Persekutuan yang dibentuk pada 1948.

Ini diperkukuhkan lagi dengan kewujudan dinasti kesultanan yang tertua di dunia iaitu kesultanan Kedah yang diasaskan pada tahun 1136. Tidak dapat dinafikan bahawa latarbelakang negara ini berhubungkait dengan sistem pemerintahan Melayu.

Tetapi, sekiranya Malaysia ditonjolkan sebagai negara Melayu dalam konteks semasa, ia akan menimbulkan kegelisahan di kalangan dua komponen rakyat Malaysia. Bagi Bumiputera Sabah dan Sarawak, khususnya Kadazan dan Iban, konsep identiti nasional sedemikian seolah-olah meminggirkan mereka.

Begitu juga bagi kaum Cina, India dan minoriti lain di Semenanjung Malaysia, termasuk, Orang Asli yang bukan Islam.

Kedua, di kalangan orang Melayu terdapat beberapa kumpulan yang berpegang pada idea bahawa Malaysia adalah sebuah negara Islam. Benar, majoriti penduduk negara — lebih 60 peratus — adalah penganut agama Islam. Malah, sebelum zaman kolonial, Islam merupakan asas perundangan di dalam sistem pemerintahan kesultanan Melayu.

Tetapi, sudah tentu 40 peratus masyarakat bukan Islam tidak dapat mengidentifikasikan diri mereka dengan negara yang mengisytiharkan dirinya sebagai negara Islam. Sekiranya, komponen warganegara yang begitu besar merasa terasing daripada identiti sebuah negara, usaha menyatupadukan masyarakat berbilang agama ini akan terancam.

Ketiga, bagi majoriti bukan Melayu pula Malaysia adalah sebuah negara berbilang kaum dan agama. Itulah identitinya. Deskripsi Malaysia sebagai negara berbilang kaum dan agama mencerminkan realiti masyarakat kita.

Tetapi, bagi sebahagian besar bukan Melayu realiti ini terpisah daripada sejarah dan latarbelakang negara yang berakar-umbi dari sistem Melayu-Islam. Ini menyumbang kepada keengganan mereka mengiktiraf peranan istimewa bahasa Melayu dan agama Islam dalam pembentukan identiti negara.

Jelas, ketiga-tiga perspektif yang dibincangkan tidak menepati pencarian satu identiti nasional. Oleh yang demikian, apakah konsep identiti yang paling sesuai, yang peka pada sensitiviti semua kaum di negara kita?

Ternyata konsep yang termaktub dalam Perlembagaan Malaysia adalah konsep yang adil, sesuai dan menepati sifat-sifat identiti bagi negara dan rakyat kita.

Perlembagaan Malaysia mengiktiraf kedudukan Bahasa Melayu sebagai bahasa kebangsaan dan bahasa rasmi yang tunggal. Islam juga dinobatkan sebagai agama Persekutuan. Ini adalah pengiktirafan dan penerimaan terhadap sejarah dan latarbelakang negara dalam pembentukan identiti Malaysia.

Dalam hubungan ini, peranan Bahasa Melayu sebagai bahasa kebangsaan, khususnya, amat penting dari segi evolusi identiti nasional. Dalam masyarakat berbilang kaum walau di mana-mana, jika bahasa dapat memudahkan komunikasi antara kaum dan budaya yang berbeza, ia akan membantu proses interaksi dan integrasi.

Inilah peranan yang dimainkan oleh Bahasa Melayu sepanjang sejarah sebagai lingua franca (bahasa perantara) yang paling berkesan dalam mewujudkan identiti serantau Nusantara.

Kembali kepada Perlembagaan Malaysia, dokumen ini juga mengiktiraf kedudukan dan peranan bahasa-bahasa lain.

Pada masa yang sama, Perlembagaan kita menegakkan hak penganut agama-agama bukan Islam untuk mengamalkan agama masing-masing. Akomodasi bahasa-bahasa bukan Melayu dan agama-agama bukan Islam dalam Perlembagaan adalah pengakuan bahawa bahasa-bahasa dan agama-agama ini juga adalah sebahagian daripada identiti Malaysia.

Kepimpinan nasional — kerajaan mahu pun pembangkang — gagal menyebarkan kefahaman identiti yang adil dan seimbang ini yang merupakan kekuatan Perlembagaan kita kepada khalayak.

Sekiranya sistem persekolahan kita, dari sekolah rendah sehingga sekolah menengah, memberi tumpuan kepada perkara ini — mempertingkatkan kefahaman pelajar-pelajar tentang Perlembagaan sebagai asas identiti nasional — sejak Merdeka pada 1957 dahulu, mungkin suasana masyarakat kita lebih harmonis pada hari ini.


Sebenarnya, konsep identiti dalam Perlembagaan telah dikembangkan secara tidak langsung melalui Rukunegara dan Wawasan 2020. Oleh kerana identiti tidak terbatas pada soal kaum dan agama semata-mata, dua dokumen nasional yang penting ini memperkukuhkan lagi konsep identiti Malaysia yang juga merangkumi institusi-institusi serta nilai-nilai.

Sistem Raja Berperlembagaan, Keluhuran Perlembagaan, Kedaulatan Undang-Undang dan sistem Demokrasi Berparlimen, yang ditekankan di dalam Rukunegara juga mencirikan identiti negara kita.
Begitu juga nilai-nilai yang terkandung dalam Rukunegara seperti perpaduan, keadilan, pendekatan liberal terhadap kepelbagaian budaya dan tradisi masyarakat, dan sikap progresif terhadap sains dan teknologi merupakan dimensi-dimensi penting dalam usaha kita membentuk identiti rakyat dan negara Malaysia.

Wawasan 2020 terus memberi keutamaan kepada nilai-nilai murni yang sama. Malah, dokumen ini juga menyuarakan iltizam negara untuk mewujudkan masyarakat yang "berjiwa bebas, tenteram dan maju dengan keyakinan terhadap diri sendiri" dan melahirkan masyarakat beretika dan bermoral.

Nilai-nilai ini boleh dianggap sebagai nilai-nilai yang berpaksikan kepada Kepercayaan pada Tuhan iaitu, prinsip pertama Rukunegara. Dalam sebuah masyarakat dimana lebih daripada 80 peratus penduduknya percaya pada Tuhan, prinsip ini harus diterima sebagai ciri utama identiti bangsa Malaysia.

Untuk memastikan bahawa kepercayaan pada Tuhan adalah prinsip identiti yang benar-benar dihayati, adalah menjadi tanggungjawab kita semua untuk menegakkan keadilan, keihsanan dan kejujuran dalam kehidupan masyarakat Malaysia.

Perlembagaan, Rukunegara dan Wawasan 2020 yang menjurus ke arah identiti nasional pada hakikatnya termaktub dalam idea 1 Malaysia. Ini bermakna bahawa 1 Malaysia merupakan intipati identiti Malaysia.

Menegak dan mengukuhkan identiti rakyat dan negara adalah cabaran besar yang dihadapi oleh kita pada ulang tahun Kemerdekaan Malaysia yang ke 55, terutamanya akibat beberapa perkembangan semasa. Di peringkat domestik, sentimen kaum dan agama lebih ketara dan menjejaskan usaha ke arah identiti nasional.

Identiti nasional juga terancam akibat politik kepartian yang melampaui batas. Di peringkat global, proses globalisasi yang membawa impak pada hampir setiap budaya dan bahasa sudah mula menggugat bahasa kebangsaan dalam bidang-bidang tertentu. — Utusan Malaysia

Saya berdoa supaya pemimpin politik kita terutama Pak Menteri-Menteri Kabinet sekarang dapat menghayati apa yang dinyatakan oleh Dr. Chandra, jangan dok sibuk kira berapa undi boleh dapat dari kaum itu dan ini sahja!

GE 13... to call or not to call this year

The decision when to dissolve Parlimen to make way for the elections to be called by the SPR (Suruhanjaya Pilihan Raya Malaysia) rest solely on the Prime Minister of Malaysia. However we citizens have the right to speculate when the General Elections will happen. Many speculated that the GE will happen three months ago...nothing happened.

Looks like the elections would not be called this year from the statement given by the BN Secretary General:

BN sec-gen: Difficult to hold polls this year

The Haj season makes it difficult for polls to be called between September and November, said Barisan Nasional secretary-general Datuk Seri Tengku Adnan Tengku Mansor.
He said the Government must carefully consider whether or not it would be a good idea to call for the 13th general election then.

“October is definitely not a good idea. If we do call for polls in October, people will say we are not sensitive to Islam,”
he said after breaking fast with residents here on Sunday night.

He said it was thus highly unlikely for Malaysians to hit the ballot boxes any time this year.

Analysts and pundits have been speculating that Prime Minister Datuk Seri Najib Tun Razak could call for polls soon, especially after his revelation that he would table the 2013 Budget on Sept 28 instead of October.

Some were of the view that the Prime Minister would dissolve the Parliament not too long after the Budget is tabled, paving the way for either a later October or early November general election.

My guess is that it looks like the elections will be held next year, after Hari Raya Cina......and the guessing game continues.

Bizarre decision by the Court of Appeal today

The news from TheStar today Wednesday 8 August 2012:

Appeals Court restores bound over decision on Noor Afizal 

PUTRAJAYA:
National Tenpin bowling ace Noor Afizal Azizan escaped custodial sentence as the Appeals Court Wednesday allowed his appeal to restore the decision of a Sessions Court which bound him over for good behaviour for five years, in a sum of RM25,000 for committing statutory rape.

A three-member panel led by Court of Appeal president Tan Sri Raus Md Sharif unanimously set aside the five-year jail term imposed on Noor Afizal by the Malacca High Court in allowing the prosecution's appeal for an enhanced sentence.
Raus, in his decision, agreed with counsel Hisyam Teh Poh Teik that public interest would not be served if Noor Afizal was sent to jail as he had a bright future.

Court of Appeal Judges Datuk K. N. Segara and Datuk Azhar Ma'ahwere the other two judges presiding on the panel.

On July 5, last year, the Malacca Sessions Court bound over Noor Afizal, 21, for good behaviour on a bond of RM25,000 for five years in one surety after he pleaded guilty to committing the offence on a 13-year-old girl at a hotel in Ayer Keroh, Malacca between 12.30am and 5am on June 5, 2009. - Bernama


I think there is something wrong in this story, a rape is a rape and is therefore a serious crime punishable by a custodial sentence, and if the reporter is to be believed, the President of the COA said that "public interest would not be served if Noor Afizal was sent to jail as he had a bright future"..... really your Learned Lordships? The perpetrator of the crime does not go to jail because he has a bright future? Maybe the full argument was not reported but the gist of the decision is frightening to us innocent bystanders who have underaged daughters to say the least.

Wow, maybe next time a good defense counsel could argue that Rafizi who is being charged under BAFIA if found guilty need not go to jail as he is exposing a possible wrongdoing and public interest would not be served if he is sent to jail as Rafizi has a bright future in politics? 

Some one said that "Not only must Justice be done; it must also be seen to be done" but today the COA does not show that justice is seen to be done with this bizarre decision. 

It is a sad day today but definitely bright day for those who have a bright future.

Hard to imagine that Rafizi is covered under our Whistleblower Protection Act

Much has been said about the arrest and the charging of PKR's Rafizi Ramli and a former bank Clerk Johari Mohamad under Section 97(1) of the Banking and Financial Institution Act (BAFIA). Read the story here

The opposition as usual tried to spin the story and attempted to make Rafizi as some sort of a folks hero, a mythical whistleblower being charged because he is exposing wrongdoings they say. Hmm, while I am all for a citizen of this country exposing corruption and abuse of power, however one must do it through the proper channel, and yes the SPRM or the PDRM is a good and legitimate place to start as we have  the Whistleblower's Protection Act already in place read here.

Rafizi was charged under the BAFIA act for exposing confidential Bank Information to two journalists at the PKR HQ on 7 March 2012 and Johari was charged with abetting him. In all this whistleblowing bravado and what not, we should not lose sight of the fact that this blessed country has laws to protect its citizens and Rafizi as a citizen cannot take the law in his hands despite whatever "noble" intention that he may have. 

I do not know whether the duo, Rafizi and Johari realise is or not, but they may have done serious harm to our banking and financial institutions, they are in serious trouble for exposing confidential banking details and definitely not because they are exposing wrong doings at NFC or even the Ampang LRT Extensions. 

If they are allowed to be free, then can any Tom, Dick, Ali, Chan or Muthusamy  obtain secret banking information about an individual and expose it in public and ask to be legally protected because they are "exposing a wrong"? How does a layman not trained in law define a criminal act which could turn out to be just fitnah? That is why we have the Whistleblower Protection Act!

I hope when the case comes to trial and the duo if found guilty should be given exemplary sentences to deter others from doing what they have done thereby exposing our Banking and Financial system to harm which in turn will affect our Economy and even Investments from overseas. Money and jobs will be lost to other neighboring countries who protects their Banking and Financial  Security and confidentiality tightly.

Congrats to George Kent-Lion Pacific JV, but....

So the wait for the international bid for the Engineering Procurement Construction Testing and Commissioning of System Works for the Ampang LRT extension is over. Finally George Kent-Lion Pacific JV got the lucrative job after much controversy.

Congratulations to the George Kent-Lion Pacific JV for winning the bid despite fierce competition from other highly qualified and experienced bidders namely: 

1.George Kent-China Railway Construction-Tewet GmbH; 
2.Posco-Sojitz-Daewoo International-Thales; 
3.Invensys-Balfour Beatty Rail-Ingress; 
4.Colas-CMC Engineering-Thales; 
5.Samsung-LG-Thales; 
6.SNC Lavalin-WW Engineering-Bombardier; 
7.Siemens-Scomi Engineering 
8.Ansaldo-Emrail-Leighton.

But wait a minute how come George Kent won the bid in a JV with Lion Pacific whereas its original bid for the project is in JV/Grouping with China Railway Construction and Tewet GmbH?  

Can a JV/Grouping name change be allowed after a bid has been closed under an international bid?

What is the implication of this JV/Grouping name change on award, and what would be the reaction of the other international heavyweights who bid for this project?
